Terms of Use

1. About these terms

These terms set out the conditions for using the mobile app Aquaria (the “App”), provided by Ask White (“we”, “us”). By installing or using the App, you agree to these terms and to Apple’s Licensed Application End User License Agreement (EULA). If you do not agree, please do not use the App.

2. What the App does

The App lets you set up aquariums (“tanks”) with fish and other creatures, and watch them in iPhone widgets on the Home Screen, Lock Screen and in StandBy, or inside the App. You can feed your fish, but feeding and care are never required. Your fish never die and never get weaker.

3. Your data

  • All data — tanks, fish, decorations and settings — is stored on your device only: inside the App and in an on-device area shared with its widgets (an “App Group”).
  • The App has no accounts. We do not run any server that receives or stores your data.
  • Deleting the App also deletes its data from your device. We cannot recover data that has been lost from your device.

4. Free features and purchases

  • Free: your first fish (blue tang, sardines, pufferfish, goldfish, jellyfish and koi), widgets, feeding, and viewing in the App (including water and bubble sounds).
  • Packs are one-time (non-consumable) purchases made through Apple’s In-App Purchase: the Freshwater Pack, Coral Reef Pack, Pond Pack, Sea Creatures Pack, Japanese Seasons Pack, Deep Sea & Glow Pack, Decorations & Background Themes, and the Ambient Sound Pack (stream, rain and deep-sea sounds, plus a sleep timer).
  • All-in is a one-time purchase that unlocks every pack available at the time of purchase and every pack added to the App afterwards, at no extra charge.
  • The App has no subscriptions and no ads.
  • Payments are processed by Apple. Prices are shown on the App Store and in the App before you buy.
  • You can restore your purchases with “Restore Purchases” on any device signed in to the same Apple Account.
  • Refunds are handled by Apple in accordance with Apple’s policies; we are unable to issue refunds directly. Content from a refunded or revoked purchase will no longer be available.

5. Try in Tank

Try in Tank lets you place paid fish in your tank temporarily, free of charge. A trial is not a purchase: when it ends, the paid fish leave your tank. A trial never costs anything and never turns into a purchase automatically.

6. Notifications

We do not send push notifications for advertising or to encourage purchases.

7. Changes to the App

We may update, change or discontinue features or content of the App. The “packs added in the future” included with All-in means packs we add to the App while we continue to offer packs in it.

8. Prohibited conduct

You may not modify or reverse-engineer the App (except where permitted by law), access paid features by unauthorized means, or use the App in any way that breaks the law.

9. Disclaimer and limitation of liability

The App is provided “as is”. How widgets move and appear may depend on iOS and the state of your device (for example, Low Power Mode). To the extent permitted by law, we are not liable for indirect or consequential damages or for loss of data arising from use of the App. Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded.

10. Governing law and jurisdiction

These terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute relating to these terms. This does not affect any mandatory consumer protection rules of the country where you live.

11. Changes to these terms

We may revise these terms. The latest version is published on this page, with its date shown at the top. We will announce important changes in the App or on this page.
